UPDATE: The City of Gosnells (City) lodged an updated Environmental Review Document (ERD) to the Environmental Protection Authority (EPA) in late 2022 seeking consent to advertise the ERD.  On 16 January 2023, the City was advised that advertising of the ERD may occur, however, it was noted the Department of Water and Environmental Regulation suggested the City undertake additional water monitoring over winter.

The City has undertaken additional surface and groundwater monitoring over the winter period within Precincts 2 and 3 of the MKSEA. The water monitoring data was provided to the EPA after the peak rainfall period and supplemented previous data collected by the City over a number of years.

The City has advertised for public comment the following proposals:

  • Amendment No. 166 to rezone land in Precinct 3B from Rural to Business Development;
  • Amendment No. 169 to rezone land in Precinct 2 from Rural to Business Development; and
  • Environmental Review document.

The City has reviewed all public submissions and provided a report to the EPA (Summary and Response to Submission). The EPA released Report 1757 on 3 April 2024 with a recommendation to the Minister for Environment to not implement Amendments 166 and 169.

The City’s position is that it rejects the EPA recommendations and has lodged an appeal with the Office of the Appeals Convenor. Further information on the appeal can be viewed at the Office of the Appeals Convenor website.

Precinct 2

  • The MRS amendment to rezone Precinct 2 from Rural to Industrial was gazetted on 14 October 2016.
  • Amendment No. 169 to TPS to rezone MKSEA Precinct 2 from General Rural to Business Development was initiated by Council on 13 December 2016 and forwarded to the EPA for consent to advertising for public comment.
  • Council completes an Environmental Assessment and Management Strategy, Local Water Management Strategy, Geotechnical, Traffic, Bushfire Management, and Aboriginal Heritage reports for Precincts 2 and 3B.
  • EPA determines that the Scheme Amendment is to be formally assessed - 3 September 2018.
  • EPA issues Instructions for ER of the Scheme amendment - 21 December 2018.
  • ER completed by the City of Gosnells and forwarded to EPA in May 2021.
  • EPA requested further information in the ER document. Consultants engaged to undertake the additional work required by the EPA.
  • The ER was reviewed by the (EPA).
  • The EPA has released public advice that aims to enhance the long-term protection of the Greater Brixton Street Wetlands. For more information visit www.epa.wa.gov.au.
  • The ER document and scheme amendment report was advertised for public comment.
  • The City has reviewed all public submissions and provided a report to the EPA (Summary and Response to Submissions).

Precinct 3A

  • The MRS amendment to rezone Precinct 3 from Rural to Industrial was gazetted on 14 October 2016.
  • Precinct 3A - Amendment No. 165 to TPS 6 to rezone Precinct 3A from General Rural to General Industry was approved on 12 December 2016.
  • The WAPC approved a structure plan for Precinct 3A on 25 August 2017.
  • The WAPC approved a Structure plan amendment for precinct 3A on 9 December 2021.

Precinct 3B

  • The MRS amendment to rezone Precinct 3 from Rural to Industrial was gazetted on 14 October 2016.

What will happen next?

  • Environmental Review report - The Office of the Appeals Convenor will review the appeals and prepare a report to the Minister for Environment.
  • Amendments 166 and 169 to Town Planning Scheme No. 6 - Following a decision by the Minister for Environment, Council will then determine the scheme amendments and provide a recommendation to the WAPC/Minister for Planning.
